Cancellation+ Waiver Program Terms and Conditions 

These Terms and Conditions (these “Terms and Conditions”) for the Cancellation+ Waiver Program (the “Waiver Program”) are incorporated into the terms and conditions of your purchase. To the extent that these Terms and Conditions are inconsistent with the terms and conditions of your purchase, the terms and conditions of the booking or reservation platform on which you made your purchase or the terms and conditions of the event owner or operator identified on the booking or reservation platform where you made your purchase (the “Event Administrator”), these Terms and Conditions will control.  

In these Terms and Conditions, the words “you,” “your” and “Customer” mean the person who purchased a ticket, reservation or registration for an event (an “Event”) from the Event Administrator and paid the fee specified by the Event Administrator to participate in the Waiver Program (the “Waiver Fee”). The words “we,” “us” and “our” mean the Event Administrator. 

If you elected to enroll in the Waiver Program by paying the Waiver Fee, then subject to the requirements and limitations of these Terms and Conditions:  

  • We will grant a limited waiver as described in these Terms and Conditions of our standard cancellation policy for the Event (“Standard Cancellation Policy”). Under our Standard Cancellation Policy, all sales are final and nonrefundable at the time of purchase.  
  • In accordance with the limited waiver of our Standard Cancellation Policy, if you are unable or decide not to participate in the Event for any reason, you will have the right to receive a refund of the Net Ticket Price (as defined below) or, if we offered a rebooking option when you enrolled, subject to availability, you will have the option to rebook at no additional cost for the same type of event scheduled to occur within 30 days of the original Event Start Time or the end of our season, whichever occurs first, so long as— 
  • your cancellation request is received by us at least 24 hours before the starting time for the Event set by us (the “Event Start Time”);  
  • no exclusion under these Terms and Conditions applies; and 
  • all other requirements of these Terms and Conditions are met.  

The Waiver Program only covers the Net Ticket Price paid by you and does not cover any travel expenses or other expenses or losses incurred by you or any other person, whether related to the Event or not. 

To enroll in the Waiver Program, you must pay a Waiver Fee for each per-person ticket, reservation or registration you purchase for the Event. Only a per-person ticket, reservation or registration for which you have paid a Waiver Fee will be eligible for refund or rebooking if applicable. You may not enroll in the Waiver Program after the date of your purchase of the ticket, reservation or registration for the Event unless we grant permission for late enrollment in writing. We may change the Waiver Fee at any time without notice, but any change in the Waiver Fee will not be applied to Customers who have already paid the Waiver Fee. 

You may cancel your enrollment in the Waiver Program any time within 24 hours of paying the Waiver Fee for a full refund of the Waiver Fee. If you cancel your enrollment in the Waiver Program, our Standard Cancellation Policy will apply, and you will not be entitled to a refund of the Net Ticket Price or any other amount or rebooking if you cancel your participation in the Event for any reason. If you cancel your enrollment in the Waiver Program, you may not re-enroll at any time and, if your enrollment in the Waiver Program included persons for whom you handled a group ticketing, reservation or registration, no person in that group may re-enroll in the Waiver Program at any time. If you or any person in your group attempt to re-enroll, even if the re-enrollment is processed and a Waiver Fee paid, neither you nor any member of the group will be eligible for a refund of the Net Ticket Price or any other amount or rebooking, but we will refund any Waiver Fee in full upon request.  

Revocation for Communicable Disease: If we or our service provider determine at any time that the spread or threatened spread of a Communicable Disease may have an adverse effect on the Event for which you have purchased a ticket, reservation or registration, we may revoke the waiver of our Standard Cancellation Policy granted under these Terms and Conditions and will refund your Waiver Fee. In this case, our Standard Cancellation Policy will apply, and you will not have a right to a refund or rebooking if you cancel your participation in the Event after we give notice that the waiver has been revoked. A “Communicable Disease” means any disease that can be transmitted by means of any substance or agent from one organism to another organism and that can cause or threaten harm to human or animal health or welfare. 

Exclusion for Terrorism: You will not be entitled to a refund or rebooking if you cancel your participation in an Event after an act of Terrorism occurs or is threatened. “Terrorism” means any activity (a) that involves any of the following or preparation for any of the following: (1) use or threat of force or violence; (2) commission or threat of a dangerous act; or (3) commission or threat of an act that interferes with or disrupts an electronic, transportation, communication, information or mechanical system or any public utility; (b) where either or both of the following applies: (1) the effect is or the intended effect appears to be to intimidate or coerce a government or civilian population or any segment thereof or to disrupt any segment of the economy; or (2) the intended effect appears to be to further political, ideological, religious, social or economic objectives or to express (or express opposition to) a philosophy or ideology.  

Notice to Customers: By enrolling in the Waiver Program, you are obtaining a waiver of the Event Administrator’s Standard Cancellation Policy. You are not purchasing insurance. Nor are you being insured under any policy held by the Event Administrator or any other person. The Waiver Program is not an insurance policy for your ticket, reservation or registration, and it is not intended to replace any travel, ticket or other insurance coverage you may have. You should consult an insurance professional to evaluate your personal insurance needs. 

THE WAIVER PROGRAM PROVIDES A LIMITED WAIVER OF THE EVENT ADMINISTRATOR’S STANDARD CANCELLATION POLICY FOR THE EVENT. UNDER THE STANDARD CANCELLATION POLICY, ALL SALES ARE FINAL AND NONREFUNDABLE AT THE TIME OF PURCHASE. THE WAIVER PROGRAM IS NOT INTENDED TO REPLACE A CUSTOMER’S TRAVEL OR TICKET INSURANCE OR ANY OTHER INSURANCE COVERAGE. THE WAIVER PROGRAM IS NOT TRAVEL OR TICKET INSURANCE OR INSURANCE OF ANY TYPE. THE CUSTOMER IS NOT AN INSURED, ADDITIONAL INSURED OR LOSS PAYEE UNDER ANY POLICY OF INSURANCE.   

By paying the Waiver Fee you acknowledge that you have read and understand these Terms and Conditions and agree to be legally bound by them. 

What We Will Refund or Provide for Rebooking:

Under the Waiver Program, you are eligible for a refund of the Net Ticket Price if you cancel your participation in the Event for any reason at least 24 hours before the Event Start Time, so long no exclusion applies under these Terms and Conditions and you otherwise meet the requirements of these Terms and Conditions. The “Net Ticket Price” means the sum of the amount you paid for a ticket, reservation or registration for the Event, the amount you paid for items or products purchased from us in connection with the Event that we have not shipped at the time of your cancellation request and all applicable sales taxes. The Net Ticket Price does not include any processing fees you paid or the cost of any items or products shipped before you requested a refund. We will not pay for items or products lost or damaged in transit. 

If we offered a rebooking option when you enrolled in the Waiver Program, if space is available in a similar Event scheduled within 30 days of the Event Start Time or prior to the end of our regular season for offering Events, whichever occurs first, at your option, we will rebook you for the available Event at no additional charge, so long as no exclusion applies under these Terms and Conditions and you otherwise meet the requirements of these Terms and Conditions. If you choose to rebook, you will not receive a refund, and our Standard Cancellation Policy will apply to the rebooked Event. Under our Standard Cancellation Policy, all sales are final and nonrefundable, meaning you will not be eligible for a refund or further rebooking if you later cancel. 

All cancellation requests must be submitted at least 24 hours before the Event Start Time. Any cancellation requests submitted less than 24 hours before the Event Start Time will not be refunded or rebooked. Rebooking is subject to availability and is not guaranteed. 

Other Considerations: 

  1. The Waiver Program only covers per-person tickets, reservations and registrations for which you have paid a Waiver Fee.   
  1. All refunds will be processed electronically to the original payment method that was used during the purchase or registration process. If payment fails electronically, a check will be mailed to the address used by you during purchase or registration. 
  1. Our obligation to reimburse you will be reduced to the extent you receive reimbursement of any portion of or all of the Net Ticket Price from an insurer, sponsor, promoter or other third party. 

Refund or Rebooking Request Process: 

If you are unable or decide not to participate in the Event for any reason, you must notify our service provider, Copernican, no less than 24 hours before the Event Start Time. You can contact Copernican at www.getcopernican.com. You must provide your booking or reservation ID, the name of the Event, the Event date and the reason for your cancellation request. If your request is approved, we will refund the Net Ticket Price by your original payment method or, if applicable, rebook. If you request is denied, you will receive an email stating the reason for the denial.
